These terms apply to your use of clickcatalyst.au, the Click Catalyst Growth Efficiency Audit and any other site or tool that links to them (together, the "Services"). The Services are provided by Click Catalyst (ABN 80 664 685 623) ("Click Catalyst", "we", "us"). By using the Services, you agree to these terms. If you don't agree, please don't use them.
The audit
The Growth Efficiency Audit is a free, automated review of a website's email, SMS and lifecycle marketing setup. It's based on publicly available information about the website and the answers you give us. It's general information only. It isn't financial, legal or professional advice, and it doesn't take your full circumstances into account.
Automated analysis can miss things or get things wrong. For example, it may not see content that only appears to some visitors, or tools that a website loads in ways our systems can't detect. Any estimates in a report, including revenue opportunities, are illustrations based on assumptions. They are not promises of results. You should make your own assessment before acting on a report.
Websites you submit
Only submit a website that you own or are authorised to act for. When you submit a website, you allow us to visit it and record publicly available information about it, including screenshots, so we can prepare the audit. As part of an audit, we may also sign up to the website's public email or SMS signup forms using an address we control, to review the messages it sends new subscribers.
Acceptable use
You must not:
- use the Services for anything unlawful, misleading or harmful;
- submit false information, or someone else's details without their permission;
- try to overload, disrupt, scrape or reverse engineer the Services, or get around any usage limits;
- use the Services to analyse a website you're not authorised to act for, or to target a third party.
We may limit, suspend or refuse access to the Services at any time, including where we reasonably believe these terms have been breached.
Intellectual property
We own the Services and their content, including the audit method, scoring and report design. You may use a report we prepare for you for your own internal business purposes. You may not resell it or present it as your own work.
Your consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't lawfully be excluded.
Liability
Subject to your consumer rights above, and to the extent the law allows:
- the Services are provided "as is", and we don't guarantee they will be accurate, complete, uninterrupted or error free;
- we are not liable for any indirect or consequential loss, or any loss of profit, revenue, data or opportunity, arising from your use of the Services or any report;
- where our liability can be limited but not excluded, it is limited to supplying the Services again.
Privacy
Our Privacy Policy explains how we collect and handle personal information.
Third-party links and tools
The Services may link to, or rely on, websites and tools run by other companies. We aren't responsible for their content or how they operate.
Changes
We may change the Services or these terms at any time. The latest version of the terms will always be on this page. If you keep using the Services after a change, you accept the updated terms.
Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
